A LAWYER IS NOT AN EXPENSE IN A DIVORCE CASE - THEY ARE AN INVESTMENT!

If you find yourself in the position of needing a divorce or help with time sharing or Child Support or Modifications to some agreements already in place, then you may want to hire an attorney.  While Florida does offer a variety of forms online for those who want to do it themselves, it can be a difficult thing to attempt on one’s own due to the many factors involved.  If you have children or property or your spouse is not in agreement about divorcing, then you might find it necessary to hire an attorney to guide you.

Florida is a No-Fault divorce state. This means that there is no necessity to show any wrongdoing on the part of either spouse, but one must show that the marriage is “Irretrievably Broken” this is a legal term meaning that there is no realistic possibility for the marriage to be successful if continued.

When there are children involved in a divorce, a parent’s first priority should be to make the transition as smooth as possible for the children, and the court looks to ensure that any decisions as to custody or visitation are in the best interests of the child.  In Florida, Child Support is determined by the income of each parent and is based on Statutory Guidelines.

Often following a divorce, events might happen which result in changed circumstances, such as unanticipated medical costs or other things, that require a Modification of an existing order for Time Sharing/Custody, if you need a Modification you might want the assistance of an attorney to help you.

Finally, if you are the primary custodial parent and you are not receiving your support payments, or they are less than what is owed or you receive them sporadically, you might want to hire an attorney to assist you in having your child support order enforced or the non-paying party might be held in contempt of the court’s order to pay child support.
